WHAT IS A CALIFORNIA ADVANCED HEALTHCARE DIRECTIVE?
Simply put, a way to protect what matters
Protect What Matters Today
Advance healthcare directives, often called living wills, are very important even though most people have never heard of one. Living wills or advance directives allow you to choose what type of medical decisions will be made on your behalf if you become incapable of making these decisions yourself. Generally, a living will should be paired with a power of attorney which would allow a person to make other types of decisions for you if you become unable.
At South Coast Estate Plans, we are experienced California estate planning attorneys who can draft an advanced healthcare directive for your current place in life. We understand your desire to have a confidential advocate and are here to assist you.

CALIFORNIA ADVANCED HEALTHCARE DIRECTIVE EXPLAINED
Why Should I Make a Living Will?
Living wills take the burden from certain important decisions from your family members. It makes it so they don’t have to make the tough challenges of when to pull the plug or stop treatment if you become vegetative or no longer able to act. This can save them from the guilt and pain of having to make these decisions for you and can avoid inevitable disagreements between family members of what actions to take.
A good example of this occurring is in the Terri Schiavo case from the early 2000s. In this case, Terri became vegetative and her husband and legal guardian wished to pull the plug because that is what she would have wanted. The parents disagreed and a protracted legal battle ensued. If Terri had a valid living will already effectuated, then no legal battle could have occurred and her husband and parents could have had a healthy grieving process instead of a legal battle which most likely has permanently ruined anything semblance of friendship.
Protect What Matters
Whether your earnings, business interests, or loved ones. Feel confident that what matters to you is protected today.
What Can I Decide in a Living Will?
We recommend using established and tested living will language that has successfully withstood legal scrutiny. While you technically can write anything in a living will, anything that goes against medical standards of care and appears to support assisted suicide will be ignored and ineffective, at least in the United States. Generally the things that you should choose are if you wish for the plug to be pulled if you become permanent vegetative or totally brain dead. You also should choose if you wish to undergo serious treatments that are only to extend your life by several months at the expense of great pain. Please contact our office and we can walk you through what we think should be included at a minimum and we can work with you to do what you think is best for you and your family.
Be Prepared
We recommend that you have a living will regardless of your age. Whether you are young or old, the end of life can happen unexpectedly and you want to be prepared. You also should consider updating an old living will. Some old documents may not meet your current desires and may also be outdated in such a way that they may not be legally binding.
